摘　　要："一带一路"建设是中国政府提出的利我利他的宏伟国家战略。中国应从国内和国际两方面加强环境法律制度建设:在国内应当主动规制海外投资的环境行为,推进中资企业的社会责任,利用金融机构加强对海外投资环境行为的监督;在国际层面,中国应充分发挥亚投行的作用,利用双边和多边条约来规制海外投资行为。＂The Belt and Road＂ Project is the grand national strategy put forward by Chinese government which will benefit both China and the neighboring nations en route. Due to the fact that the B＆R project is planned to give priority to the development of infrastructure, China＇s investments will bring various impacts on the environment of the nations en route. In order to achieve the win-win strategic target, the Chinese people should strengthen the sructuring of the legal system of environmental protection from two aspects： the domestic and the international. On the one hand, in the domestic area, China should take the initiative to regulate the environment related behavior of the oversea investors, promote the social responsibility of Chinese enterprises, and use the financial institutions to supervise the environment related behavior of the oversea investors. On the other hand, in the international area, China should give full play to the-function of AIIB, use the bilateral and multilateral treaties to regulate the behavior of oversea investors.
