职务犯罪案件跨区域管辖制度的现状及完善

摘　　要：面临现阶段反腐的高压态势,如何有效地惩治职务犯罪,成为检察机关亟待解决的课题,而明确职务犯罪的管辖权更是解决这一课题的关键。文章在概述了职务犯罪管辖的司法现状,评析指定管辖、异地管辖等现有制度的基础上,论述了职务犯罪案件管辖存在的问题及其原因,最后指明构建职务犯罪跨区域管辖应遵循的原则,提出完善法律规定、构建明确适用条件、适用原则等具体内容的制度设置以及相关配套机制的立法建言,同时强调完善与纪检监察部门的衔接,以期为建立高效、公正、透明的职务犯罪管辖制度提出建议。At the present stage of high pressure of anti--corruption, how to effectively punish duty crimes has become the problem which is urgent to be solved by the procuratorial organs. To accurately define the jurisdiction right of duty crimes is the key to solve that problem. On the basis of summarizing the current judicial situation of cross-regional jurisdiction of duty crimes, com- menting on the existing systems of the designated jurisdiction and jurisdiction of other places, the group discusses the problems in the established jurisdictional systems, as well as analyzes the causes. At last, the group points out the principles of establishing the cross-regional jurisdiction of duty crimes, offers legislative suggestions on constructing the concrete systems of cross-regional ju- risdiction of duty crimes, such as the rules of applied conditions and principles, and improving some relevant supporting mecha- nisms of cross-regional jurisdiction of duty crimes, and emphasizes the connection with discipline inspection and supervision de- partments in order to estabhsh a more efficient, fair and transparent jurisdiction system of duty crimes.
