论外资对我国境内企业的控制及法律应对策略

摘　　要：海量的外资顺应中国引进外国优良资本、先进技术和管理经验的政策涌入中国,这些外资在带来经济联动效应的同时,也伺机从市场、股权、品牌和技术等多方面控制中国境内企业。对此,应从完善外资准入制度、实行国家安全审查机制、建立和完善信息报告和监督检查制度等几方面,对外资控制中国产业进行预防和规制。When China issued policies to introduce good foreign capital, advanced technology and management experience, large amount of foreign funds flooded into China. These foreign funds, when bringing economic linkage, try to control Chinese domestic enterprises in market, stock ownership, brand, technology and so on. Therefore, to prevent and regulate the control of foreign funds in Chinese domestic enterprises, we should perfect access system for foreign funds, implement national security investigation mechanism, establish and perfect information and report system as well as supervision and inspection system.
