摘  要:当代东亚各国的刑事自首制度均来自于我国古代,但因经过了法制现代化的洗礼,又与我国古代有较大差别。以《大清律例》为代表的我国古代法典,对自首之盗贼采取较当代各国更为宽容的处理方式。在自首后果上,大幅度减免刑罚;在自首主体方面,"遣人代首"及"亲属首告"均等同于犯罪人本人自首;在自首的对象处,除官府外,亦可于事主处"首服";此外,明列一些"不准首"的项目。从表面上看,这一制度的具体规则似乎常常不符合形式逻辑,但在实质上,它却符合生活在这片土地上的中国人心中的情理、伦理,体现出一种超越逻辑并高于逻辑的独特法律理性。The surrendering rules in criminal laws in most East Asian countries nowadays are rooted in Chinese ancient times. However,these rules are very different from their origin after the process of modernization.In Chinese ancient Code such as the Qing Code,thieves surrendering themselves could be treated more tolerant than in most countries in modern times,unless in some extreme occasion recorded in the code. In case of surrendering themselves,the punishment put on them would be reduced accordingly. Beside thieves themselves,their relatives or other people they appealed to could surrender in place of them. They could surrender to the government as well as to the victims. These rules appeared to be out of formal logic,but actually,they matched the rational and ethical feeling in Chinese people's heart.
