摘 要:基本公共服务均等化软法之治与治理的密切联系在于,当代中国在社会转型中出现了风险社会的民生困境,这促使人们运用基本公共服务领域的软法机制来达到对此问题的有效治理。在基本公共服务领域,软法之治在治理体系和治理能力方面存在若干问题,这些问题需要从软法机制自身的完善入手来加以解决。走向善治是基本公共服务均等化软法之治的应然之境,为实现此愿景,基本公共服务均等化的软法之治应注重提升主体治理能力和优化软法治理体系。The close contact with rule of soft law in the field of basic public services equalization and the governance lies in the fact that China' s well-being problems happening in risk society have caused people to think about how to effectively govern the problems by the soft law. In the field of basic public services, the rule of soft law has some problems in the aspect of the system of governance and governance capability, which should be solved by the perfection of the rule of soft law. Good governance is the ideal status of the rule of soft law in the field of basic public services equalization. To achieve this goal, the rule of soft law in the field of basic public services equalization should pay attention to the enhancement of governance capability and optimization of soft law governance system.
