摘  要:随着高校毕业生自主就业政策的实施,应届高校毕业生在就业过程中与用人单位之间发生诸多劳动纠纷,由于现行劳动立法的欠缺,应届毕业生无法获得劳动法的保护。高校应届毕业生具备劳动者主体资格,也有适用劳动法保护的立法和现实依据,具有适用劳动法保护的可行性,立法机关和政府相关部门应加快高校毕业生劳动权益保护的立法工作。With the implementation of the independent college graduates employment policy, there have been many labor disputes between fresh college graduates and employers in the employment process. A great many new graduates fail to get the protection of the labor law due to the lack of the existing labor legislation.College graduates can be qualified as labor subject. There are also legislation and the reality basis applicable for labor law protection. It is feasible to applicable to the labor law protection. Therefore, Legislature and relevant government departments should accelerate the process of legislation of college graduates of labor rights and interests protection.
