摘　　要：传统专利制度的本质在于对技术的保护,专利创造性需要"所属技术领域"作为评判标准,传统植物药以传统知识形式披露的药物价值用途可以成立医药用途专利,对其创造性的考察应从传统植物药本身特有的传统知识结构评判上述要素,以期符合传统植物药医药用途专利的创造性要求。The essence of the traditional patent system lies in the protection of technology, patent inventive needs ＂skill in the art＂ as the evaluation standards, traditional plant medicine in the form of traditional knowledge to disclosure value of drug use may be protected by medical use patents, traditional plant medicine investigation about its invention should from itself characteristic of the traditional knowledge structure to judge the above factors, in order to meet the requirements of the traditional plant medicine in patent inventive.
