摘　　要：赫尔南多·德·索托在《资本的秘密》中揭示了资本主义发展的秘密——合法的所有权制度。西方发达国家通过建立完备资产法律体系,提取资本,有利市场的流通;发展中国家或者穷人看见的只是一堆固定资本,僵化的资本,却无法从中受益。从钟罩概念入手,分析历史钟罩、制度钟罩及内涵,对发展中国家具有借鉴意义。在市场经济的背景下,回顾中美各国在打破钟罩方面的探索,具有一定理论与现实意义。提倡对合法财富的保护,确立生产要素确权,土地合理流转,减少流通成本,促进市场经济建设。In the book＂The Mystery of Capital＂,Hernando de Soto revealed the secret of capitalist development-the legitimate ownership system.Through the establishment of the legal system of complete assets,the developed western countries extracted capital to promote the market circulation,while developing countries or the poor see just a bunch of fixed capital or rigid capital without benefiting from it.Starting from the＂bell＂concept,the paper analyzed the history bell jar,system bell jar and their connotation.Hernando de Soto thought that the wealth gap between the western developed countries and other countries cannot be explained by Cultural Determinism,which is of great importance to the developing countries today.Under the background of market economy,this paper,which is a review of China and the United States in breaking the＂bell＂exploration,has certain theoretical and practical significance.
