摘　　要：非行政许可审批是《行政许可法》颁布之后在行政审批实践中形成的一个衍生类型。近两年来,以清理形式进行的非行政许可审批改革在全国范围内迅速展开,具有行政动员性和形式上的改革彻底性。出于对以往行政审批改革过程中问题的解决,有必要对非行政许可审批起止过程中的合法性及改革的风险性问题进行深入反思与检视。应对的策略是:以法律规制的方式,通过完善立法从源头上对行政审批权力进行约束。改革目标能否实现的关键性条件是政府职能的实质性转变。The non-administrative licensing approval is formed in the practice of administrative examination and approval after the enacting of Administrative License Law.In the last two years,the reform of non-administrative licensing approval has been launched throughout the country rapidly and thoroughly,which has a character of administrative mobilization and thorough reform in form.Based on the previous problems existing in the past reform of the administrative examination and approval,it is necessary to make a in-depth reflection and revision on the problems such as the legality about the establishment and cancellation process of non-administrative licensing approval,as well as the risks of the reform.The replying strategy is to restrict the power of administration from the source by perfecting the law.The key conditions of reform＇s success lies in whether the government functions can really be transformed.
