试论行政诉讼提级管辖改革——以系统工程分析为视角

摘　　要：30多年前,钱学森先生首次提出法制系统工程的概念,旨在将科学与法治相结合,探索系统化的法治道路与具体制度。然而30多年过去了,系统工程法学会仍在筹备阶段,交叉学科建设进展缓慢,法律体系的混乱无时无刻不在凸显着法治系统工程的缺失。在法律体系初步建成的今天,泛泛而谈法治系统或者法律体系的建设已显得落伍,因此,笔者选取了行政法学上一个具体的问题——行政诉讼提级管辖的改革,并运用博弈论及运筹学具体说明提级管辖改革不存在技术上的障碍,却无法达到其实现审判公正的主要目标,也印证系统工程对法学研究、法律制度建设的重要性。30 years ago,Mr. Qian Xuesen first proposed the concept of the legal system works,it aims to combine scienceand the rule of law,to explore the rule of law and the specific system in a systematic way. However,30 years later,the sys-tem is still in the preparatory stage of the project law,the interdisciplinary construction progress is slow,the chaotic legal sys-tem highlights the lack of systems engineering of the rule of law. Initially built in the legal system today,the discussion onthe legal system of the rule of law system construction has become out of date,so this paper selects the specific question inthe administrative law- reform of administrative proceedings under the jurisdiction,and uses game theory and logistics tostate that there are no technical obstacles in the authorities level jurisdiction reform,but it has failed to achieve its main ob-jective to achieve a fair trial,and also confirms the importance of systems engineering for law research and legal system con-struction.
