摘 要:美国雇佣法惩戒解雇制度的原则经历了一个"随意"到"正当"的渐次呈现过程。从"七标准"到"义务目的统一"模式,再辅以"公共政策抗辩"等,形成了美国雇佣法惩戒解雇制度正当原则"三位一体"的基本蕴含。当前,其理论不断深化,深刻地影响美国联邦和州的立法、司法判例及雇主的惩戒解雇决策。考察和研究美国雇佣法惩戒解雇制度的正当原则与适用,可以对完善中国劳动法惩戒解雇制度及其适用带来诸多有益启迪。The principle of the employment laws disciplinary dismissal system has gradually experienced a" At – will"to a"Just cause"process in the United States. from the"Seven tests"to"obligation and objective"model,along with the" public policy exception",etc.,which formed the "the trinity"of the basic implication of just cause principle of the employment laws disciplinary dismissal system. At present,theory of just cause principle is deepening,and profoundly affect U. S. federal and state legislation,judicial precedent and the employer's disciplinary dismissal decision. Studying the understanding and applying of the just cause principle of the employment laws disciplinary dismissal system in the United States can bring some enlightenment on disciplinary dismissal system in our country.
