摘 要:交通规划民营化不仅有其特定内涵以及特有的民营化模式,而且基于现实与理论的双重驱动,以及裁量权的理性回归与政府职能改革的深入推进,该项制度也有其存在的合理性基础。在制度构建层面,为了能够在实践中更好地彰显该制度的功效,需要运用法治的思维和方式对所涉主体的权利(权力)义务(职责)进行科学合理的配置。在实体上,应当推进交通民营化政策规范的制定,建立交通规划民营化管理委员会,明确交通规划民营化的适用条件,并确立监管交通规划民营化的法律依据。在程序上,还应在规划准备、草案拟定以及规划确定三个阶段予以具体的制度设计。Privatization of transportation planning not only has its specific connotation and unique mode of privatiza- tion, but also is based on the dual driving of reality and theory. With the rational return of discretionary power and the deepening of government reform, this institution also has its own basis for legitimacy. In terms of institutional building, in order to better demonstrate the efficacy of the institution in practice, it is necessary to use the rule-of-law mindset and meth- odology to perform scientific and rational configuration of rights (power) and obligation (duty) of stakeholders. In terms of entities, it is necessary to promote the making of policy and regulations that govern the privatization of transportation plan- ning, to set up a commission for the privatization process, to specify the applicable conditions for the privatization of trans- portation planning, and to establish a legal basis for regulating the privatization process. With regard to procedures, it is imperative to conduct specific institutional designing in three stages : planning and preparation, drafting of the plan, and fi- nalization of the planning.
