国际档案所有权争议产生及其解决机制

摘　　要：国际档案所有权争议因其产生原因的特殊性和复杂性,一直是世界上普遍存在且难以有效彻底解决的问题之一。其解决途径离不开完善相关国际法律、法规,加强国际合作,坚持平等互利,必要时可以通过谈判甚至向设在荷兰海牙的国际法庭提起确认国家档案所有权诉讼等原则与方法。妥善并顺利解决国际档案所有权争议有助于维护各国档案全宗完整性,捍卫拥有合法所有权国家的利益与正当权益,也有利于维护和促进世界和平。Due to the？particularity and complexity of its cause, International archives property rights have been one of the prevalent problems that cannot be solved completely. The problem cannot be solved without relevant international laws and regulations, international cooperation and adherence to the principle of equity and mutual benefits. When necessary, negotiation could be held or ever a lawsuit could be filed to the International Court of Justice in the Hague, Holland in order to determine the ownership of national archives. Proper solution of this problem contributes to protecting the integrity of each country＇s archives, defending the national interests and legitimate rights of its legal owners. It is also conducive to protecting and promoting world peace.
