摘　　要：依法推进政府职能转变的提出,是基于以往历次政府职能转变主要是依靠权力和关系在体制内封闭进行,缺少法制的刚性约束,导致不断反复。推动国家治理现代化使破解这一难题有了突破口,即政府职能转变作为实现国家治理现代化的必然要求,必须纳入国家治理法治化轨道,运用法治思维和法治方式,在法律框架内进行,通过建立和完善行政法律规范体系,合理规范权力运行,建设善治意义上的治理服务型法治政府,以更好地体现现代国家治理所内蕴的现代法治精神,加速向现代国家转型,并在这个过程中不断依法解决国家治理现代化中的各种问题,更好地体现制度的正义和自信。To promote the transition of government function, put forward in accordance with the law, is based on any past govern- ment function transformation mainly rely on the power and the relationships within the system closed, lack of the rigid constraints of the legal system and lead to constant. The modernization of national governance a breakthrough in the problem of crack is put forward, name- ly the change of government function as to realize the requirement of the modernization of the national governance, the orbit must be in- cluded in the national governance, using the rule of law thinking and way of the rule of law, the legal framework, through establishing and perfecting administrative law system, the reasonable standard power operation, the construction of service-oriented government under the rule of law, good governance in the sense of governance in order to better reflect the intrinsic spirit of modern rule of law, modern state governance to accelerate the transformation to modern countries, and constantly in the process in accordance with the law to solve the various problems in modernization of governance, to better reflect the justice system and self-confidence.
