摘　　要：刑罚执行直接影响被害人的权利保障。推进以审判为中心的诉讼制度改革,加强刑罚执行中的被害人权利保障,必须完善刑罚执行制度,包括统一刑罚执行体制,使执行主体从多元到一元,为被害人权利提供制度保障;转变刑罚执行方式,从封闭到公开,为被害人参与执行留出空间;重构刑罚执行变更程序,从行政化到诉讼化,为保障被害人权利创造环境。Penalty execution has a direct effect on the victim＇ rights protection. To promote the reform of trial - centered lawsuit system and strengthen the victim＇s rights protection, the system of penalty execution must be improved, including unifying the penalty execution system to change the executive main body from multivariate to mono - variate and provide system guarantee for the victim＇s fights ; transforming the mode of penal execution from the closed to the public to make room for the victim participating in execution; reconstructing penalty change procedures from administration to litigation to create the environment for the victim＇s rights protection.
