论法律评价的三种精神

摘　　要：法治精神、人文精神和时代精神是法律评价的三种精神。法治精神是法律评价在法治中国建设中的精神之魂,人文精神是法律评价在和谐社会建设中的精神基石,时代精神是法律评价实现反思超越的精神自觉。在司法实践中,法律评价既通过摒弃人治精神,体现良法善治的法治价值,从而回归到法治精神中建设法治国家;又通过化解矛盾纠纷,维护社会民众的现实权益,从而回归到人文精神中建设和谐社会;还通过不断推进司法改革,实现中国的法治梦,最终回归到时代精神中实现反思超越。The spirits of rule of law, humanistic spirit and time spirit are the three kinds of spirits for legal evaluation. The spirit of rule of law is the soul of the law evaluation in the legal construction of China. Humanistic spirit is the spiritual foundation of the law evaluation and plays a role in the way of constructing harmonious society. Time spirit is the spiritual consciousness of the law evaluation in the process of completing reflection and making more progress. In the judicial practice, law evaluation reflects the good value of the rule of law through abandoning the spirit of rule of men and then returns to the spirit of rule of law to construct the country ruled of law; it also maintains the real rights and interests of people by resolving conflicts and disputes and then returns to the humanistic spirit to construct harmonious society; furthermore it realizes China＇ s legal dream through continuously pushing forward judicial reform in judicial practice, and finally returns to time spirit to realize reflection and development.
