从人与自然共生关系看中国环境健康法制建设

摘　　要：人与自然存在着共存共生的和谐本质联系,人是自然界的一部分,人的发展不能超越自然规定的限度,人行为的"越位"与无序将招致自然的"非意识报复",二者应在一个系统的范畴内达成整体和谐共荣。中国的经济跃进改变了人与自然共生共存的关系,二者由融合趋向分离,而环境法制不张导致人体生命健康的巨大危害。缺乏对环境健康的针对性调查、对污染风险监测不当,公众参与度与法律执行度过弱、"过度博弈"下的短视法制思维是制约环境健康法治的核心因素。应通过建设数据库研究分析考核系统、完善生态预警机制、构建污染检测控制系统及标准、细化环境健康危害判断基准、构建公害公知公众参与平台和发展环境健康管理新思路,全方位构建科学的环境健康法律制度体系。There is a harmonious and essential coexistence between mankind and nature with the former as part of the latter. Man's development shouldn't trespass the limits of nature. The trespassing and chaotic activities of human beings will only result in nature's 'unconscious payback',so the two should reach an organic and harmonious relationship within a system. China's rapid economic development has changed the coexistence between humans and nature,whose close bond has begun to disintegrate,while the insufficient implementation of environmental laws has caused tremendous harm to mankind's health. Factors such as lack of investigation targeting environmental health,inappropriate supervision of pollution risks,limited public participation and law enforcement,and shortsightedness in legislative thinking in the context of 'over gaming',are the core issues in restricting the legal protection of a healthy environment. We should analyze evaluation system through database construction,improve ecological alarm system,build pollution detecting and monitoring system,specify benchmarks for environmental health,establish a platform for public participation and awareness,and develop a new mindset in environmental management,thus construct a scientific and legal system for environmental health in an all-round manner.
