竞争性国企市场支配地位取得与滥用以及规制的特殊性

摘　　要：对国有企业垄断行为的规制一直是我国反垄断法的法益目标和题中应有之意。竞争性国企作为具有市场优势的经营者,在激烈的市场竞争环境中,极易滥用其市场支配地位,给市场竞争造成严重抑制和破坏,损害消费者、其他市场竞争者的合法权益。因此,对于竞争性国企滥用市场支配地位的规制,成为当下反垄断法学研究的重要课题以及反垄断法执法的重要任务。竞争性国企市场支配地位的取得及其滥用的特殊性决定了法律规制也有其特殊性,为了使其滥用市场支配地位行为得到更有效、更科学的规制,需要对其市场支配地位的取得、滥用及其法律规制的特殊性进行详细梳理和深入研究,为合理规制竞争性国企滥用市场支配地位的反垄断执法实践提供有针对性的理论支持。Monopoly regulation of state-owned enterprises has always been the legal interest and meaning of anti-monopoly law in our country.In the fierce market competition environment,competitive state-owned enterprises as the operators with market advantage are likely to abuse its dominant market position,and bring severe suppression and destruction to the market competition,impair the legitimate rights and interests of consumers and other market competitors.Therefore,the regulation of abuse of dominant market position of the competitive state-owned enterprises have become the important subject of anti-monopoly law study as well as an important task of anti-monopoly law enforcement.The particularity of the acquisiton of market dominant position of state-owned enterprises and their abuse determines that the legal regulation also has its particularity,in order to make their abuse of dominant market position behaviors get more effective and scientific regulation,it needs to make a detailed summary and in-depth research of its acquisition and abuse of dominant market position,also the particularity of its legal regulation,to provide theoretical support for anti-monopoly law enforcement which aimed at properly regulating market dommant position of competitive state-owned enterprises.
