摘  要:2014年北京APEC会议上我国计划在2030年设定碳排放总量最大限值,为此我国将逐步扩大碳交易市场版图,进行跨区域碳交易。然而由于全国性碳交易立法缺失和地方性立法差异性较大,导致跨区域碳交易市场处于无序状态。在借鉴欧盟、美国较为成熟的区域性碳排放权交易立法的基础上,通过构建跨区域碳排放权交易立法协调机制,对碳配额"适区"分配,跨区交易,集中监管,联动执法,为我国在"十三五"期间建成全国性碳排放权交易市场的立法体系提供理论支持。During 2014 Beijing APEC meeting, China planned to set maximum limits for carbon emissions in 2030. However, due to the lack of a national carbon trading legislation and differences between local legislation, it resulted in a disordered state of the overall carbon market. In reference to a more mature regional carbon emissions trading legislation of the EU and the US. This article describes the formation of information exchange, coordination and the balance of the interests of the conflicts and other function, inter-regional coordination mechanism to build legislative carbon emissions trading by establishing cross-regional coordination committee. In this article we develop regional carbon emissions trading substantive law, procedural law, for reasonable allocation of the carbon quotas, cross-region trading, and consolidated supervision, together to enforce the law, for the poppers of providing theoretical support for legal system of the construction of a national carbon emissions trading market during "China's 13th Five-Year Plan".
