摘 要:排污权市场的失灵,源于不合理的法律制度导致了过高的交易成本。具体而言,排污权交易成本过高的制度原因表现为三大方面:法定交易主体范围狭小等原因导致搜寻成本过高,部分妨碍自由议价的行政许可事项及政府干预排污权二级市场定价的行为导致议价成本过高,非正式排污权转让合同的法律定性不明导致合同监督成本攀升。对此,改良之道在于放宽法定排污权交易主体的限制、放松排污权价格管制、简化并逐步取消排污权交易事前审核程序和明确非正式排污权转让合同的效力。The emission trading market failure is due to the unreasonable legal system design which leads to the high transaction costs. The specific reasons for the high cost of emission trading include the following three aspects. The narrow range of the legal transaction subject leads to the high search costs. Because the law sets some administrative license procedures which hinder the freedom to bargain and intervened directly in the price of secondary market of emission right, the bargaining costs are too high. The nature of the informal emission right transfer contract on the law is not clear, so the supervision costs rise. For this, there are some improved ways in the law, as to ease restrictions on the subject of emission trading, to loosen the price controls on emission trading, to simplify and phase out the pre audit procedures of the emission trading and to clear the effect of informal emission right transfer contract.
