法治视野下信访终结的现状、目的及模式

摘　　要：重复信访问题日渐成为困扰国家治理的顽症,建立信访终结机制已成共识。需要厘清信访终结概念,分析和论证其存在的正当性,明确信访终结的直接目的、根本目的和终极目的,进而科学选择信访终结的模式,这有助于信访制度走向法治化。宪法框架下的人大审查终结模式是最佳之选。Repetitious letters and visits becomes a chronic problem that plagues the national governance. Consensus has been reached that the termination mechanism of letters and visits is necessary. It is important to clarify the concept of the termination mechanism of letters and visits. We should analyze and demonstrate the legitimacy of the termination mechanism. In addition, making clear the direct purpose, the fundamental purpose mid the ultimate purpose of the termination mechanism contributes to make scientific selection on the mode of termination. These helps to legalizate the letters and visits system. The National People＇ s Congress to act as examiner under the constitutional framework is the best choice.
