“空心村”治理的法律意义分析

摘　　要："空心村"问题屡见不鲜,各学科研究者投入了很大的热情,但法学方面研究者甚少。"空心村"问题的产生原因已在各学界达成共识,但由于分析角度不同,分析的治理意义也不尽相同,各学者依此而提出的对策也不应当一概而论。本文提出"空心村"治理的法学意义,包括对宪法、土地管理法律法规、教育法律法规、环境法等法律的维护和遵循,以及对整个法治建设的推进都有重要意义。Rural hollowing phenomenon arises, which has attracted scholars＂ concerns in various areas, except scholars majoring in law. Although scholars .in different areas have reached a consensus on the emergency reason of rural hollowing phenomenon, their research findings are not similar about the significance and counter-measures. This article analyzes the phenomenon from the law aspect, which involves laws maintainly including Constitution, Laws on Land Management, Laws on Education, Laws on Environment Protecting, and so on. The study has a significance in promoting the process of Ruling by Law in China.
