摘 要:作为应然选择和刑事理论共识,罪刑法定原则遵循形式理性和形式公正的结果当然禁止习惯法的适用。但在刑事制定法禁止藏族"赔命价"作为一种刑事习惯规则适用的当下,作为一种实然,藏族"赔命价"却依然作为"活法"、"行动中的法"适用于广大的藏区,并取得了良好的社会效果。这种应然与实然的交错运生,凸显了刑事制定法与藏族"赔命价"之间的紧张关系。对藏族"赔命价"历史流变的梳理和分析,可为实现刑事制定法与藏族"赔命价"在博弈中的和谐共生提出解决之道或启示。Being a necessary choice and common criminal theory, the principle of deciding crimes by law follows formal rationality and formal justice, and thus it forbids the application of custom law. Now criminal statue forbids the application of Tibetan "Compensation for Deaths" which is treated as a custom rule, but actually the latter is still applied widely in Tibet for it's a living law and a law in action and has obtained good social effect. The existence of what ought to be and what is shows the strained relations between criminal statue and Tibetan "Compensation for Deaths". This paper analyses the history and changes of Tibetan "Compensation for Deaths" in order to provide solutions and enlightenment for the harmonious existence of the two objects.
