摘 要:公众对我国食品安全的担心主要来源于食品添加剂。食品添加剂引发的食品安全问题的根本原因是,我国食品添加剂违法的法律责任不完善,特别是刑法打击食品添加剂的犯罪力度不够,存有一定的局限性。这些局限性主要表现在食品添加剂违法主体与食品安全犯罪的主体以及客体存有错位、我国刑法食品安全犯罪罪名单一、违法生产销售食品添加剂的行政责任与刑事责任没有对接。完善食品添加剂犯罪刑事责任的基本思路是,要树立"重典治理的理念",完善我国刑法中关于食品安全犯罪的相关条款,增设违法生产食品添加剂罪名,为打击食品添加剂犯罪提供法律依据。A major concern from the public about food safety is the legitimate use of food additives. The root cause of a food safety problem by the use of food additives is the imperfections of our legal liability provisions, especially the functional limitation against the food additive crime under our criminal law. It can be identified by misplacing the subjects violation of food additive use and food safety crime with its object of crime, single accusation, and the disconnection between the administrative penalty and criminal liability regarding the illegal manufacturing, sales of food additives. The grounding rules to remedy our system is to establish a mind of "stringent governance", streamline the relevant articles in our criminal law and create new accusations for various food additives crimes to provide legal backing to the framework.
