摘　　要：能源法的法哲学研究目前在我国极不发达,已成为影响我国能源法学深入发展的瓶颈。能源自身的物质特性和人们对其哲学认知,以及人们对于能源所持的态度即能源伦理,还有能源规律构成了能源法的法哲学基础。能源的有限性、分布不均和污染性等特性,是其节制、安全、清洁等价值存在的基础;对能源本质、意义及价值所在的哲学认知,有助于充分深化人们对能源法问题的认知;围绕能源与人、能源法与人所展开的探讨,构成能源法法哲学的人性基础和伦理之维;能源自身以及能源生态、能源经济等规律,更是能源法法哲学研究不可缺的科学基础。我国能源法研究的迫切任务之一就是深入地进行能源法的哲学研究,将能源法学研究推进到法哲学的高度,唯此我国能源法学研究才有坚实的理论基础。Legal philosophy research about energy law is not done adequately in China at present, which has become the bottleneck of energy law researches. The material properties of energy, people＇s philosophical cognition of energy, people＇s ethical attitude to energy, and natural law of energy constitute the legal philosophy basis of energy law. Energy properties like limited and uneven distribution and pollution are the factors determining whether the energy is safe or clean and whether it should be restrained. A philosophical understanding of the nature, the significance and the value of energy help to improve people＇s attitude to energy law. Studies around energy and people, and around energy law and people are the law philosophy foundation relating to human nature and ethics; energy itself, energy ecology, energy economy form the scientific basis of legal philosophy researches. To sum up, legal philosophy research should be given priority in researches on energy law in China as it contributes to a solid theoretical foundation in this field.
