摘　　要：对不良行政行为的立法规制是治理不良行政行为的治本之举,而现行的法律制度对不良行政行为的规制存在着制度的缺位与不足。应当通过立法明确规定不良行政行为的责任追究制度、法律救济制度,使对不良行政行为的监督走上规范化、制度化、常态化的轨道。然立法对不良行政行为的规制不是万能的,应恪守有所为和有所不为的基本准则。Regulative maladministrative action by legislation is the fundamental measures of governing and the current legal system of maladministrative action is imperfect.In order to normalize regulation of maladministrative action,we must provide the accountability and legal remedy system about it by legislation and regulative maladministrative action by legislation is not omnipotent,we ought to abide by the spirit of doing certain things and refraining from doing other things.
