统筹城乡发展过程中农村残疾人土地权益保障机制研究

摘　　要：统筹城乡发展过程中,农村土地价值得到了显现,农村土地权益分配和权益保障受到社会各界的普遍关注。农村残疾人兼具农民和残疾人双重身份,是残疾人中的特殊群体,由于残疾人行为能力受限,农村残疾人土地权益受损现象较为普遍。农村残疾人土地权益受损的根本原因是社会对农村残疾人的歧视,自身能力欠缺是主观原因,而相关法律制度缺失是直接原因。当前亟需从风险防范、法律保障、权益实现和权益救助四个方面着手构建农村残疾人土地权益保障机制,切实维护农村残疾人的土地权益。Amid balancing urban and rural development, rural land values have been revealed. Also, the distribution and protection of rural land rights have been widely concerned by all walks of life. Rural disabled people have a dual identity of farmers and persons with disabilities, as a special group with dual difficulties. The phenomenon of land rights violation is common because their capacity for action is limited. Rural disabled people＇s land rights and interests was damaged, and the root cause of is social discrimination against disabled persons in rural areas. Their lack of capacity is subjective reasons, but lack of relevant legal support is the direct cause. Currently, it＇s urgent to construct protection mechanism of rural disabled people＇s land rights and interests in terms of risk control, legal protection, realization and aid of rights, in order to safecluard the land riqhts of disabled persons in rural areas.
