城乡规划管理的“法治”与“人治”逻辑——兼论体制改革的方向

摘　　要：新常态下,依法治国与社会联动治理相辅相成,城乡规划管理的逻辑随之改变,既要以公平为基础进行依法治理,又要在安定的要求下规范和整合社会关系。通过对权力的合法性来源、异化形式和组织架构的梳理,可以清晰地看到城乡规划管理以公平性为核心,进行权力分配与约束的法治逻辑。源于传统,我国城乡规划管理运行中"人"对组织模式、治理手段和处理社会关系方式的选择,体现了"法治"下以协调为重心的"人治"逻辑。"法治"与"人治"并不矛盾,可以通过契约基础上的集体治理逻辑和技术手段的优化实现协调。Rule by law and social involvement governance complement each other, and urban rural planning shall regulate and coordinate social relations. Equity is the essence of legislated urban rural planning management. The choice of executives in traditional urban planning management on organization model and governance approach reflects the coordination centered rule by man under law. ＂Rule by law＂ and ＂rule by man＂ can be coordinated by collective governance logics and technical improvement based on the spirit of contract.
