社会化矫正视角下的未成年人犯罪研究——基于河南省未管所和郑州市女子监狱的调研数据分析

摘　　要：未成年人犯罪是一个复杂的社会问题,与成年人犯罪相比有其自身的特点和规律,更多地表现为无知与感情冲动,应被视为未成年人在社会化过程中出现的偏差现象,需用社会化的方式方法来矫正。针对我国在未成年犯矫正方面的问题,提出应扩大非监禁刑罚措施的适用,如缓刑和假释的适用广度与深度;大力推进监禁刑执行的开放化,完善我国的暂时离监制度并逐步建立我国的未成年犯开放式处遇制度;完善社会化矫正的社会支持系统,包括个体支持系统和机构支持系统。逐步构建多部门协调配合,社会广泛参与的未成年犯社会化矫正体系,有效促进未成年犯再社会化的顺利进行。Juvenile crime is a complicated social problem. Compared with adult crime, it has its own characteristics and rules, characterized by ignorance and emotional impulse.It should be seen as a deviation phenomenon in the socialization process of juveniles, which needs a social approach to correct. In view of the problems in the field of the correction of juvenile delinquents, we put forward to expand the application of non - confinement penalty measures, such as the application scope and depth of probation and parole; Vigorously promote the opening of execution of imprisonment, improve the system of temporarily leaving prison and gradually establish a system of open penalization of juvenile delinquents in china; Improve the social support system of social correction, including individual support system and institutional support system. Gradually build a social correction system of juvenile delinquents with multisectoral coordination and social wide participation, and effectively promote the smooth progress of resocialization of juvenile delinquents
