摘　　要：从应然和实然角度,建立一套科学、高效、可操作性强的技术调查制度,对于提高我国现行专利确权和侵权处理机制的效益具有基础性和长远性的重要意义。通过对引入技术调查制度的必要性、国外专利技术调查制度的考察、我国专利确权和侵权技术调查制度的历史演变等方面予以分析和论证,最后提出完善相关制度的建议,以期为健全我国技术调查制度提供一些建设性的意见和参考。Establishing a set of scientific, high-efficiency and enforceable technique investigation systems is a basic and long-range significance with regard to improve the benefits of current determination of patent right and infringement. This paper analyses and demonstrates the necessity of technique investigation system, foreign countries ~ technique investigation system and the historical development of the determination of patent right and infringement investigation system. At last, the author gives some suggestions that we should improve our patent-related systems which may be an idea or a reference to complete technique investigation system in our country.
