摘 要:司法与民意的传统研究容易陷入"大词法学"的困境,问题症结就在于对民意的看法太过粗糙,尤其是缺少民意概念的语境分析和民意面相的学术分类。为走出困境,需要将司法语境下的民意界定为"部分无直接利害关系的人就某一司法问题表达的意见",同时考量关注对象、表达内容、表现方式等综合标准将民意划分为"直接民意和间接民意"。无论是直接民意还是间接民意,都与司法分享两个层面的合理性:一是价值合理性,二是冲突合理性(必然性)。司法与民意的良性互动有基础的理论支撑,基于各自特点,对于直接民意,需要建构一套机制化的、可操作的回应模式,重在积极回应,主要是微观层面的构建。对于间接民意,需要建构一套整体的系统的机制性策略,重在能动应对,主要是中观层面的构建。The traditional study of justice and public opinion was often trapped in the dilemma of "big judicature", which can be ascribed to the simplified understanding of public opinion, especially the absence of a contextual explanation of its definition and its academic classification. In order to break off the dilemma,this paper suggested that public opinion be defined as "some person who partially has no direct interest expresses his opinions on a judicial issue" and be classified into direct and indirect public opinions in terms of the concerned object, content and expression. The distinction is judicially reasonable in two aspects:value reasonableness and conflict reasonableness. The interaction between justice and public opinion is theoretically supported by respective features. For direct public opinion, a procedural, operable response mode should be built up and a system of whole mechanism for indirect public opinion.
