中医处方“保密权”与患者知情同意权的冲突与对策——以法理学视角分析

摘　　要：中医处方是针对患者各异病情制定的,可以作为技术秘密受到保护;患者基于自主性而享有对所接受治疗的知情同意权,其应当包含就诊时中医开具的处方,由此可见,二者在权利上存在冲突。产生这种冲突的原因是法律对双方权利范围规定不甚明确,可以通过完善相关立法、制定行业规范等措施,有效化解他们之间的权利冲突。Traditional Chinese medicine（TCM） prescriptions,which are formulated clue to different conditions of the patients,should he protected as the technical secrets.Patients are entitled to the right of informed consent based on autonomy,which should include TCM prescription in the treatment.However,there is a conflict of rights between them,which is due to the unclear range of rights between two parties.This conflict of rights can be effectively solved through perfecting relevant legislations and industry standards.
