界定恐怖主义犯罪概念应注意的问题

摘　　要：对于恐怖主义犯罪的定义,因各国的见解并不相同,导致对恐怖活动的预防和打击不力,因此,应就如何界定恐怖犯罪的概念达成共识。在界定恐怖主义犯罪概念时应当注意以下几个问题:其一,应当正确认定恐怖行为的实施者;其二,对恐怖行为的鉴别应符合全人类保护人权的观念;其三,界定恐怖行为应认清当代恐怖主义犯罪的共同点;其四,恐怖主义犯罪的定义应体现本国特色。Because different countries have different views on the definition of terrorism crime, which leadto the ineffective prevention and attack of terrorism. Therefore, it should be agreed on how to define theconcept of terrorism crime. When defining the concept of terrorism crime, the following questions shouldbe paid attention to: first, perpetrators of terrorist behavior should be correctly determined; secondly, theidentification of terrorist action shall comply with all of the protection of human rights concepts; thirdly,what the contemporary terrorism crime has in common should be recognized in defining terrorism;fourthly, the definition of the terrorism crime should reflect their own characteristics.
