出示执法证件的法学界定与民警现场处置策略——以邯郸交警被要求出示执法证案例为例

摘　　要：近年来,机动车违法行为逐渐增多,公安机关交通管理部门也加大了对其打击和惩处力度。有些机动车驾驶人法律意识淡薄,对交通警察的执法检查进行阻挠,拒绝接受处罚,有的还对交通警察进行谩骂、推搡和殴打。从邯郸交警被要求出示执法证这一典型案例入手,依据行政告知的有关事项,深入剖析相关法律、法规中对执法人员的要求和交通警察执法中适用的法律条款,分析案例中执勤警察是否应当出示执法证件,从而进一步探究交通警察在调查、处理交通违法行动中的相关处置策略。In recent years, motor vehicle violations are gradually increased, the traffic management departments of the public security organs have also stepped up its efforts to combat and punish. Some motor vehicle drivers are lack of legal consciousness, so as to obstruct traffic police enforcement and refuse to accept the punishment, and some of whom even abuse, shove and beat the traffic police.Starting from the typical case that Handan police were asked to show their law enforcement certificates, according to the issues related to administrative informing,the paper made in- depth analysis of the relevant laws and regulations required for law enforcement officers and the applicable legal provisions for traffic police enforcement, and analyzed whether the policeman should show law enforcement documents to further explore the related disposal strategy that the traffic police should use to investigate and process the traffic offenses.
