中德比较视野下保险业反垄断豁免制度

摘　　要：文章通过比较中德反垄断法豁免的不同规定,在总结德国保险业豁免立法沿革和制度特征的基础上,就我国对保险业反垄断法豁免予以特别规定这一问题进行分析,并结合我国实际对建立保险业反垄断豁免制度提出了建议。Through the comparison of different provisions on the exemption in anti-monopoly law between Germany and China, and on the basis of the summary of the legislation evolution and characteristics of the exemption system for insurance industry in Germany, the special provisions on antitrust exemption for insurance industry in China are discussed. Finally, combined with the reality of China, some advices on the establishment of the antitrust exemption system for insurance industry are proposed.
