图书馆以默示许可方式开展在线扶贫信息服务的版权使用规则──结合我国立法、司法和国家图书馆实践的分析

摘　　要：《信息网络传播权保护条例》(以下简称《条例》)第九条的规定是我国立法基于扶贫目的而作出的一项具有里程碑价值的版权制度创新。2010年开始,国家图书馆按照《条例》第九条的规定开展的在线扶贫信息服务对国内其他图书馆的扶贫工作有着典型的示范借鉴意义。图书馆适用《条例》第九条从事扶贫信息服务,要透彻理解与正确运用版权使用规则,从相关版权诉讼案件中汲取教训,切实保护版权,防范和化解法律风险。无论是图书馆的在线信息扶贫版权管理实践,还是扶贫版权立法,都有改进和完善的空间。＂Regulations on the Protection of the Right to Network Dissemination Information＂（ hereinafter referred to as the ＂Regulations＂ ） that article 9 is copyright system innovation of landmark value based on the purpose of poverty alleviation. Since 2010, according to article 9 of ＂Regulations＂ the National Library online information services for poverty alleviation is the typical demonstration for other libraries in China.The library is suitable for＂Regulations＂ article 9 that should thoroughly understand and correctly use the rules of the use of copyright, draw lessons from the relevant copyright litigation cases, and earnestly protect copyright, prevent and resolve legal risks. Whether management practices of library online information services for poverty alleviation, or the copyright legislation for it, there are the necessity of improving and perfecting of space.
