陕西高校“技术开发多、技术许可少”现象分析——基于知识控制权的视角

摘　　要：[目的/意义]推动高校以许可方式扩散成果是国家深化科技体制改革的重要目标,但本文发现陕西高校存在"技术开发多、技术许可少"现象;因此,识别其致因并据此提出改进策略,对于高校落实国家改革战略尤为重要。[方法/过程]论文首先采用相关利益群体分析方法识别技术开发与技术许可活动的利益主体;其次,基于技术市场交易视角,采用产权分析方法构建了职务成果知识控制权的权利结构;然后,以2015年新《促进科技成果转化法》的颁布为时间分界线,分别对比分析了技术开发和技术许可的知识权控制权在相关利益群体之间的配置结构。[结果/结论]研究指出,2015年前任何一个利益主体均不享有技术许可的完整知识控制权,而教师享有技术开发的完整知识控制权,是这一现象产生的根本原因。[ Purpose/Significance] Promoting technology licensing in universities is important for deepening the reform of science and technology system. It was found that there existed more technology development trades in Shaanxi universities＇ technology transaction than technology licensing, which is a rather disappointing phenomenon in implementing the national reform strategy in universities, and it is sig- nificant to analyze the reason of the phenomenon and propose the management mentality accordingly. [ Method/Process ] First, we identify the main stakeholders in both technology development trades and technology licensing trades with a stakeholder analysis; second, we con- struet a knowledge control fight structure of occupational sc^-tech achievements with a property-rights ana/ysis from a technology transac- tion perspective; third, comparing with technology development trades, we analyze each right configuration in technology licensing be- tween the stakeholders before and after newly amended ＂2015 Law of Promoting Transformation for Sci-tech Achievements＂ respectively. [ Result/Conclusion] The result reveals the basic reason for the phenomenon as, before 2015, none of the stakeholders has complete knowledge control right in technology licensing, while faculty scientists have complete knowledge control right in technology development trades.
