摘　　要：随着物的生态功能的被重视,物的生态价值也因环境问题而成为显性价值,故将其纳入法的调整范畴,是一种必然。将生态价值视为一种公共资源或公共产品难以避免"公地悲剧",在环境问题事业与产业并举的当下,以物的生态价值为媒介,从私法角度去构建相关法律制度,运用经济杠杆引导民众行为,是构建生态文明社会法律制度的一条可行路径。基于此提出的生态物权是指以生态物的生态价值为媒介,建立在生态物之上,以生态增益者收益和生态消耗者负担为内容的一项他物权。The ecological function of property is being attached with increasingly greater importance. Accordingly, the ecological value of property gradually becomes a dominant value owing to environmental issues, which is hereby inevitably included in the control category of laws. It is difficult to avoid ＂the tragedy of the commons＂ by regarding ecological value as a public resource or product. Nowadays, environmental issues are placed at the same position as industrial development. Consequently, it is a feasible channel to set up the legal system of ecologically civilized society by taking the ecological value of property as the medium, establishing related laws and systems from the dimensionality of judicature, and regulating people＇s behavior with economic lever. Ecological property right proposed on this basis is actually in line with the ecological value of ecological property as the medium, being established on ecological property, and taking ecological beneficiaries＇ earnings and ecological consumers＇ burdens as the content.
