全民健身公共服务的立法需求、供给与法治策略

摘　　要：运用文献资料法、逻辑分析法,对全民健身公共服务的法治供给进行研究。认为:全民健身公共服务应加强3个方面的立法:(1)涵盖全民健身公共服务的基本标准、覆盖主体、经费使用和各级政府责任等规定的高法律位阶立法;(2)划清政府购买全民健身公共服务权限,限定承接主体购买资质与行为,监管政府购买全民健身公共服务行为的制度规范;(3)合理有序使用公共体育设施和保障科学健身指导常态化的规章制度。为有效满足以上需求:在供给作为上,由供给导向的被动供给向需求导向的主动供给转变;在政策方案制定上,实行本土经验总结(内生方式)和外来经验借鉴(外生方式)相结合;在决策程序上,由经验决策向科学、民主决策转变。立法预期效果能否得以实现,需要对全民健身公共服务进行整体治理,应重点加强体育行政执法制度的实施,推进体育部门行政问责制度,培育行政主体法治信仰。The study explores the legal supply of national fitness public service by using literature review and logical analysis. It states that the legislation should be enhanced in 3 aspects,including the high-hierarchy laws which covers the basic criteria, subjects, use of funds and all-level government＇ s responsibility; the system of norms which defines the government＇ s right to purchase public service,determines the purchasers＇ qualification and behavior, and supervises the government＇ s purchasing national fitness public service ; the rules and regulations which guarantee the use of sportsfacilities and scientific guidance. In order to meet these demands, the supply should be changed from the passive-oriented supply to demand-oriented one. In the policy formulation, the experiences from local areas should be combined with the foreign experiences （external mode）. The experience-oriented decision-making mode should be changed to scientific and democratic decision-making mode. The system of administrative enforcement of law should be enhanced. The administrative accountability should be pushed and the administrative body＇ s belief of rule by law should be cultivated, etc.
