摘 要:承运人是否可以作为货物运输保险的被保险人,在法学理论、保险实务以及司法审判中一直都存在较多争议。在分析承运人作为货物运输保险的被保险人的理论基础——保险利益原则的基础上,总结研究国内外相关案例,结合保险实务中的具体商业需求,分析承运人作为货运险的被保险人的理论及现实基础。探讨保险事故发生后,根据保险损失补偿原则,承运人作为货物运输保险被保险人时保险赔偿处理的具体规则。The issue of whether the carrier can become the insured of cargo insurance has been controversial in the legal theo- ry, insurance practice as well as the administration of justice. Based on the principle of insurable interest, which is the theo- retic foundation for the role of the assured played by the carrier in cargo insurance, this paper, by examining relevant domes- tic and foreign cases, combined with the commercial requirements in insurance practice, analyzes the theoretic and practical foundation for the carrer' s role of assured in cargo insurance people. Further, the paper explores the specific rules for han- dling cargo claims by the carrier as the assured of the cargo insurance after the occurence on the incident insured which is based on the compensation principle.
