摘 要:各国刑法对吸毒行为规定不一,立法与司法实践也有明显差异。有些国家将吸毒规定为刑事犯罪,有的国家对吸毒进行法律上非犯罪化或事实上非犯罪化。吸毒刑事立法政策存在吸毒入罪、吸毒合法化、治疗替代处罚的模式。吸毒立法需基于事实的考察,从毒品的危害性、吸毒与其他犯罪的关系、吸毒犯罪的原因、政策的效果评估等事实出发,进行合理、有效的刑事政策选择。There is difference on drug - taking in the criminal laws of different countries, and ac- cordingly obvious discrepancies exist in terms of legislation and judicial practice. Some countries view drug- taking as a criminal offense, while some other countries do not. Three models of legislative policies surface in the world, namely, drug - taking as a crime, drug - taking legally permitted and medical treatment as a substitute for penalty. It is argued that the legislation on drug- taking is based on its harms, its relationship with ~ther crimes, and its causes: also, policy effect assessment must be made.
