合作治理视域下社团规章的主要效力及其实施机制

摘　　要：合作治理是一种依规则的治理,作为治理依据的规范应该是多元的。社团规章承载着社会权力的运行与实施,社会权力奠定了社团规章的效力基础,并使社团规章呈现出较为明显的公法倾向。社团成员基于共识和信任而产生的对内在"承认规则"的自愿认同,则是社团规章效力得以彰显的内在根据。社团规章主要通过其权利和义务的确定力、制裁和实施的说服力、多元利益的实现力以及内部秩序的型构力等多方面的自治力和组织力,在国家法律缺漏的地方发挥着它的社会规范作用。社团规章的实施主要不是依赖国家强制力,为确保社团规章自主性和有效性的实施,有必要建立起社团规章的声誉惩戒、关系依赖、责任共担以及法治调控等多方面的效力实施机制。Cooperation governance is a kind of one in accordance with the rules that should be diversified. Community rules bear the weight of operation and implementation of social power, which lays effect foundation of community rules and makes them present more obvious tendency of public laws. Basing on consensus and trust in community members, the voluntary approval of internal acknowledged rule serves as inner basis of effect of community rules. Community rules play the role of social norms mainly through such strengths as confirming of rights and obligations, persuasion of sanctions and implementation, realization of diverse interests and type- structuring of internal order where state laws cannot touch. Community rules do not primarily depend on the implementation of national force, in order to ensure autonomy and effectiveness of implementation of community rules, it is necessary to establish such implementation mechanisms of community rules effect as reputation retribution, relationship network dependence, shared accountability and control ,~r the rule of law_
