摘  要:伴随着20世纪70年代美国法治教育的兴起,两套各具特色的法治教材——《民主的基础》与《街头法律》相继产生。《街头法律》立足于法律条文,按法律部门进行直线式编排,因此照顾到法学的学科逻辑;《民主的基础》以法理为基础,按选定的法律理念螺旋往复,更加适应学生的法律认知发展。基于此,我国法治学科课程编制需明确与法律认知发展相适应的实施理念、基于法律传统与当代国情的内容选择、法学学科逻辑与学生身心发展相调适的课程组织。As the arising of Law-related Education (LRE) from 1970, two teaching materials about Law-related Education with unique features--Foundations of Democracy and Street Law were developed in succession. By comparative study, this paper finds that Street Law is based on law provivisions, it is a linear curriculum designed by legal units, so it can ajust the logic of jurisprudence;Foundations of Democracy is a spiral curriculum consisted of legal ideas, so it can adapt to cognitive development of students. Based on this, this study proposes that it' s very necessary to concern on the inquiry of legal issues in accordance cognitive development of law, select the learning experiences based on the legal traditions and national conditions of contempary China, organize learning experiences by the adjustment between the logic of jurisprudence and psycological sequence.
