摘 要:当前行政执法过程中矛盾纷纭,冲突频发,引发大量的群体性事件。行政执法中管理主体与管理对象的对抗与摩擦,公权与私权交叉汇合之际的高损耗、超负荷碰撞,形成和谐社会中的最不和谐音。如何防范执法风险、化解冲突,成为国家、政府、行政人员面临的共同课题。在对当前行政执法风险冲突及其缘由分析的基础上,以行政自制理论为切入点,分析和阐释执法风险防控的理念和基础,应从执法者行政品德与伦理道德观的塑立、内部行政规则的建立、行政程序制度和风险评估制度建设等方面入手,加强对行政执法风险的防控。Diverse contradictions and conflicts frequently happened during administrative enforcement of law,which have caused lots of group events. The confrontation and friction between management body and objects,high loss and overload collision between join of public power and private rights,which create the most jarring note in harmonious society. Howto prevent and control risk of administrative enforcement of lawand resolve conflicts has been the common task for the state,government and administrative officers. This article analyses and interprets the concepts based on the analysis of risky conflicting and reasons by using theory of self-restraint in administration as the standpoint and basis,and it also puts forwards the ideas and suggestions on the aspect of fundamental principles,shaping ideas and system construction to prevent and control the risk of administrative enforcement of law.
