论农村土地产权制度与家庭联产承包责任制

摘　　要：土地产权是一个复合概念,它是由土地所有权、承包权、经营权等一系列土地权益所组成的权利束。土地产权制度是对土地产权在国家、集体和个人等不同权利主体之间进行划分的基本政治经济制度,其本身并不存在优劣之分或者必然由一种形式向另一种形式过渡的问题。土地产权制度问题,本质上是不同社会发展阶段生产关系与生产力的适应问题;是生产资料所有制与国家性质的适应问题;是生产方式与传统文化的适应问题。当前,家庭联产承包责任制实施过程中存在的集体土地所有权虚置,土地流转增值权运行不畅等问题,完全能够在秉持现行土地集体所有制的前提之下得到解决。通过科学配置和规范落实不同权利主体所拥有的土地产权,集体所有前提下的家庭联产承包责任制将在促进经济发展、维护农民权利、实现政治稳定等方面发挥更大作用。Land property right is a compound concept, it is a collection which consists of a series of land rights,including ownership,operation and contracting. Land pro-perty right system is the basic political economic system which determines the disposition of land rights between different right subjects,such as state, the collective and the individual,and it doesn＇t exist the issues of value judgment and the inevitable transition trend of one form to another. Essentially, the issue of the land property right system is the adaptation problem of the production relations and the productive forces, is the adaptation problem of the ownership of the production means and the state＇s nature, as wellay the adaptation problem of the production mode and the cultural tradition.Currently, the issues of the vagueness of the collective-land ownership and the poor circulation of the land-property completely can be solved under the current collective-land ownership system. By scientifically allocate and truly commit land property between different property subjects,the household responsibility system will play much more important role in the comprehensive performance of promoting economic development,preserving farmers＇ rights and maintaining political stability.
