摘　　要：环境行政代履行制度发源于德国和日本,旨在解决环境义务履行不足问题。这一制度彰显了公私合作理念、最小损害理念和环境善治理念,有助于环境义务得到实际履行,增强环境执法的实效性,维护环境执法的严肃性。我国2011年《行政强制法》第50—52条规定了环境行政代履行及其实施程序,但该条款与环境单行法的有关规定存在相互抵牾之处。未来立法应当细化和明确环境行政代履行的适用范围、主体、程序、收费标准、法律救济等,以确保环境行政代履行专业化、规范化、制度化运作。The system of replace the fulfillment of the environmental administration originated in Germany and Japan, and aims to solve the problem of insufficient environmental obligations. This system shows the concept of public-private partnership, minimal dam-age and good environmental governance. It helps to ensure the fufillment of environmental obligation, enhance the effectiveness of envi-ronmental enforcement and to maintain the seriousness of it. The＂Administrative Enforcement Law＂ in China was promulgated in 2011, its articles of 50？52 stipulate the system of replace the fulfillment of the environmental administration and its implementation proce-dures, but these terms are contradictory with the relevant provisions of the environmental single laws. The future legislation should detail and clear the scope of application, subject, procedure, charge standard, legal relief, etc., to ensure that the system of replace the ful-fillment of the environmental administration operates in the professional, standard and institutional way.
