摘 要:将尖端医疗领域的不正当行为予以入罪化,选择何种立法模式受刑法与医疗法的双重制约。世界上主要国家对于尖端医疗犯罪的规制,有刑法典统一限制模式、逐一限制模式和中间模式。我国现行的单一刑法典模式不能涵盖尖端医疗犯罪侵犯的新型法益,医疗法规范因效力层次低无权规定独立型罪刑条文,故采用单行刑法模式是我国的最佳选择,能够对尖端医疗犯罪展开系统的、类型化的规制。When the acts in the field of advanced medicine are criminalized, its legislation model would be constrained both by the nation's criminal law and by medical law. In the world, there are three legislation models of advanced medical crimes such as united regulated by a criminal code, criminally regulated one by one and mid-model in between. The present legislation model of China is a single criminal code, which could not include new legal goods, while the medical regulations could not introduce independent criminal articles because of its lower effect level, so the best choice is to make out a slip criminal law. In it, the advanced medical crimes could be classified and regulated systematically.
