从冤假错案反思侦查观念的转变

摘　　要：冤假错案的背后普遍存在着违法侦查的情况,导致这些违法侦查行为发生的重要原因是侦查人员自身的侦查观念存在着矛盾和冲突。为此,侦查人员应通过强化证据意识、强化诉讼意识、树立正确的程序意识、培养积极的侦查意识来转变过去旧有的思维,建立起积极的侦查观念,从而规范侦查行为,减少冤假错案的发生,最终实现维护司法公平正义的目的。The phenomenon of illegal investigation is commonly found behind miscarriages of justice, and the main reason is that the investigators have contradictory and conflicting concept of investigation. Therefore, the investigators should change the old-styled thinking mode by enhancing the consciousness of evidence, litigation and procedure, as well as cultivating positive awareness of investigation. Through establishing the positive concept of investigation, normalizing the investigative activities and reducing the miscarriages of justice, the purpose of safeguarding judicial justice will be realized eventually.
