晚清域外研究与记述文献中的近代司法观念

摘　　要：晚清时期,以"开眼看世界"为特征的域外研究与考察勃然兴起,形成了众多的域外研究与记述类文献著作。这些著作中记载了大量近代西方法律制度和措施的内容,其中阐发了较为完整的近代司法观念,思想内涵尤其深刻。概而言之,晚清域外研究与记述文献对近代西方司法观念的阐发,主要是从司法独立思想、司法公正理念、司法平等原则三大方面进行的,并且促进了晚清中国传统司法理念和实践的近代化进程。The late Qing Dynasty witnessed the appearance of a large number of works and translations on foreign studies characterized by 'an effort to have exposure to the outside world'. These works contain amultitude of accounts of modern Western legal system and measures, and, in particular, relatively complete modern judicial concepts. Regarding legal studies, these works mainly elaborateon three concepts, namely, judicial independence, judicialjustice, and equality of justice. These Western judicial ideas promoted the process of modernization of traditional Chinese judicial concepts and the practice of justice.
