摘 要:征地补偿款分配权是土地承包经营权承租方参与征地补偿款分配的权利基础。现行法律虽未对该权利做出明确规定,但土地承包权与土地经营权的可分性为其提供了理论基础,而承租方受偿途径的单一性是其实践支撑。承租方征地补偿款分配权的实现存在征地补偿范围不合理、征地补偿款分配难落实等问题。在三权分置的农地权利配置尚未完成之时,应从调整对承租方的损失补偿范围入手,通过妥善保障承租方征收参与权、严格落实征地补偿款"二次分配"的方式予以解决。Land expropriation compensation distribution rights are the foundation for the lessee of land contract-management rights participate in distribution of land expropriation compensation. There are no definite provisions on the rights in the current law,but the separability of land contract rights and land management rights has offered the theoretical basis and the unicity of lessee compensated approach is the practical support. Unrational land expropriation compensation range,and difficulties to implement the land expropriation compensation distribution are the barriers against the realization of lessee land expropriation compensation distribution rights. When farmland rights allocation with three rights separation hangs in the air,the range to compensate the lessee's loss should be adjusted,the lessee's rights to participate in the expropriation should be protected properly and the way of secondary distribution of land expropriation compensation should be strictly carried out,so as to solve the problems.
